Article 17. Time limit for claims and legal actions

17.1. Time Limits for Baggage Claims

17.1.1. Acceptance of Baggage by the Passenger without any complaint at the baggage claim area shall constitute prima facie evidence that the Baggage has been delivered in good condition and in accordance with the Contract of Carriage, unless the Passenger provides clear evidence to the contrary.

17.1.2. Written Claim

Before initiating legal proceedings regarding loss, shortage, damage, or delay of Checked Baggage, the person entitled to receive the Checked Baggage must submit a written claim to Us.

A written claim shall only be accepted if it is submitted to Us by the person entitled to receive the Checked Baggage within the following time limits:

a) Within seven (07) days from the date of receipt of the Baggage in the event of shortage or damage to the Baggage.

b) Within seven (07) days from the date the Baggage should have been received in the event of the loss of one or more pieces of Baggage.

c) Within twenty-one (21) days from the date the Baggage is received in the event of delayed carriage of the Baggage.

17.2. Any feedback, request, complaint regarding service quality, or claim for compensation submitted by the Passenger shall be received and handled by Us in accordance with these Conditions of Carriage and the applicable Laws. Passengers may submit feedback or complaints directly to Us or through Our Website or Customer Service Center.

17.3. Limitation Period for Legal Action

Any legal action relating to Our liability for damage suffered by the Passenger or to the Passenger's Baggage must be commenced within two (02) years from the date the aircraft arrived at the destination, the date on which the aircraft ought to have arrived, or the date on which the carriage ceased, whichever is later. The method of calculating the limitation period shall be determined by the law of the court having jurisdiction over the case.
