Notice on Risks Related to Withdrawal of Consent for Personal Data Sharing and Deletion of Personal Data from the Electronic Identification and Authentication System (VNeID)

Sun PhuQuoc Airways is committed to complying with personal data protection in accordance with applicable laws and regulations. Passengers are kindly requested to refer to Sun PhuQuoc Airways’ Privacy Policy here for further details.

 

With respect to requests by passengers to withdraw their consent to share Personal Data (“PD”) from VNeID with Sun PhuQuoc Airways and/or to delete such PD, Sun PhuQuoc Airways hereby notifies passengers of the potential risks and impacts that may arise should we comply with such requests, as follows:

 

1. The processing of a passenger’s PD conducted by Sun PhuQuoc Airways prior to the time the passenger submits a request to withdraw consent and/or delete PD shall remain legally valid and shall not be affected by such request, in accordance with Clause 1, Article 12 of Decree No. 13/2023/ND-CP on personal data protection.

 

2. Sun PhuQuoc Airways reserves the right to refuse a passenger’s request to withdraw consent and/or delete PD in the following cases:

 

  • Where the law does not permit the deletion of data;
  • Where personal data is processed by competent state authorities for the purpose of serving state authority activities in accordance with the law;
  • Where personal data has been lawfully made public;
  • Where personal data is processed to serve legal obligations, scientific research, or statistical purposes in accordance with the law;
  • In cases of emergency relating to national defense, national security, social order and safety, major disasters, or dangerous epidemics; where there is a risk threatening national security or defense but not yet to the extent of declaring a state of emergency; for the prevention and combat of riots, terrorism, crime, and legal violations;
  • For responses to emergency situations that threaten the life, health, or safety of the data subject or other individuals.

3. Sun PhuQuoc Airways hereby draws passengers’ attention to the potential risks and impacts that may occur, including:

 

  • Passengers may be restricted, suspended, temporarily suspended, terminated, or have canceled the provision of services that require the processing of PD from VNeID in connection with the flight for which the passenger has selected online check-in, including passing through automated security screening gates, automated boarding gates, and automated access gates to the Lotus Lounge, due to Sun PhuQuoc Airways not having sufficient information or data to provide such services.
  • Sun PhuQuoc Airways shall not be liable for any losses arising from the restriction, suspension, temporary suspension, termination, or cancellation of the provision of the above-mentioned services to passengers.

4. Sun PhuQuoc Airways shall bear no responsibility whatsoever for any consequences, damages, or losses arising from a passenger’s withdrawal of consent and/or request for deletion of PD. Passengers shall not lodge complaints or initiate legal claims against Sun PhuQuoc Airways in relation to actions performed by Sun PhuQuoc Airways in accordance with the passenger’s request.
